Smile Studio Newstead — Braces Transformation Competition Terms and Conditions

1. Promoter
The promoter is Smile Studio Newstead (ABN 51 103 222 242), located at Level 1/33 Longland St, Newstead QLD 4006.

2. Eligibility
Entry is open to Australian residents aged 16 years and older. Individuals under the age of 16 must have the consent of a parent or legal guardian, who must enter on their behalf. Employees of Smile Studio Newstead, its agents, affiliates, or immediate families are not eligible to enter.

3. Competition Period
The competition commences at 8:00 AM AEST on Thursday, 1 May 2025, and closes at 11:59 PM AEST on Thursday, 31 July 2025. Entries received outside this period will not be accepted.

4. How to Enter
To enter, participants must:
(a) Follow Smile Studio Newstead on Instagram;
(b) Sign up for the Smile Studio Newstead newsletter using the provided entry form;
(c) Be aged 16 years or older, or have a parent or guardian enter on their behalf if under 16; and
(d) Be comfortable with social media filming to document their orthodontic journey if selected as the winner.

5. Prize Details
One (1) winner will receive a full fixed braces treatment valued at $7,500 AUD. The prize includes all necessary orthodontic consultations, adjustment appointments during active treatment, and retention phase appointments (including provision of retainers) with Smile Studio Newstead.
The prize does not include any dental treatments outside of the braces package (e.g., restorative dental work, general dentistry, or periodontal treatments) which may be required prior to or during orthodontic treatment. Such treatments are the responsibility of the winner and will be subject to Smile Studio Newstead’s standard fees.

6. Prize Conditions
The prize is not transferable, exchangeable, or redeemable for cash.
The prize must be accepted as awarded. If the winner is unable or unwilling to comply with these Terms and Conditions, Smile Studio Newstead reserves the right to select an alternative winner.
Treatment must commence within three (3) months of the winner being notified. Failure to commence treatment within this timeframe may result in forfeiture of the prize.
The winner agrees to participate in social media filming, photography, and content creation documenting their orthodontic journey, and consents to Smile Studio Newstead using this material for promotional purposes across its marketing channels.

7. Public Liability and Release
By participating, entrants release Smile Studio Newstead, its employees, contractors, directors, agents, and any associated third parties from any and all claims, demands, liabilities, damages, or causes of action arising from or related to the competition, including participation in the competition, acceptance, use, or misuse of the prize, or any injury or loss sustained.
Smile Studio Newstead does not accept any liability for personal injury, loss, or damage suffered by any entrant or winner, except for liability that cannot be excluded by law.

8. Compliance with AHPRA Advertising Guidelines
This competition and associated promotional materials comply with the Australian Health Practitioner Regulation Agency (AHPRA) Guidelines for Advertising Regulated Health Services.
No outcome of orthodontic treatment is guaranteed. Clinical treatment recommendations will be made following a full clinical assessment.
Prior to commencement of treatment, the winner will receive a detailed treatment plan, including all costs, potential risks, alternative treatment options, and consent documentation in accordance with AHPRA requirements.
The promotion of this prize is not intended to encourage unnecessary or inappropriate use of regulated health services.

9. Privacy
Entrants’ personal information will be collected and handled in accordance with Smile Studio Newstead’s Privacy Policy.
Information collected is used solely for administration of the competition, notification of winners, and for future marketing communications, where consent has been provided.
By entering, participants consent to the use of their name, image, and competition entry for promotional purposes without compensation, unless otherwise prohibited by law.

10. Winner Selection and Notification
The winner will be selected at random and announced on Friday, 1 August 2025. The winner will be contacted via the details provided on their entry form.
If the winner cannot be contacted, is ineligible, or does not claim the prize within 48 hours of notification, Smile Studio Newstead reserves the right to redraw and award the prize to another eligible entrant.

11. General Conditions
Smile Studio Newstead reserves the right to vary the terms of, or cancel, the competition at any time without liability, subject to relevant regulatory approval if required.
Participation in the competition constitutes acceptance of these Terms and Conditions.
These Terms and Conditions are governed by the laws of Queensland, Australia.

12. Consent to Filming and Promotional Use
By entering this competition, entrants acknowledge and agree that if selected as the winner, they consent to Smile Studio Newstead filming, photographing, and documenting their orthodontic journey.
The entrant grants Smile Studio Newstead, its affiliates, and authorised third parties an irrevocable, royalty-free, worldwide licence to use, reproduce, edit, and publish the content for promotional purposes, including but not limited to social media (organic and paid advertising placements), websites, digital campaigns, and print materials, without further compensation.
Entrants understand that their likeness, testimonials, and treatment progress may be featured publicly in association with the promotion of Smile Studio Newstead’s services.
